MINUTES OF THE MEETING OF THE
BOARD OF ADJUSTMENT
MAY 7, 2008
The meeting of the Alachua County Board of Adjustment was called to order by Pearse Hayes, Chairperson, at 6:00 PM on the above date in Conference Room 209 of the Alachua County Administration Building.
Members Present: Mr. Pearse Hayes, Mr. James Andrisin, and Ms. Jennifer Flinn
Members Absent: Mr. Robert Pratt, Mr. Tim Merrill
Staff Absent: Michael Fay Assistant Director of Transportation & Development of the Department of Public Works
Staff Present: Mr. Benny E. Beckham, Zoning Administrator, and Ms. Nathasha Washington Staff Assistant, and Mr. David Schwartz, Assistant County Attorney was also present as a spectator.
STATEMENT READ BY THE CHAIRMAN:
The following statement was read into the record by Mr. Pearse Hayes, Chair:
All persons wishing to participate and speak on an issue at the public hearing have the right, through the Chair, to ask questions of staff or other speakers, to seek clarification of comments made by staff or other speakers, and to respond to the comments or presentations of staff or other speakers. All persons wishing to participate will be sworn in prior to speaking during this proceeding”.
QUESTION ASKED BY ZONING ADMINISTRATOR
The following question was read into the record by the Assistant County Attorney, Mr. David Schwartz.
“Has any member of the board received any written or oral communication regarding any of the items on the Board of Adjustment agenda tonight? If so, please disclose the substance of the communication and the identity of the person making the communication”.
All of the board members affirmed that no communication took place prior to this evening’s meeting with respect to any of the Board of Adjustment items.
ADMINISTRATION OF OATH TO COUNTY EMPLOYEES, APPLICANTS, AND ALL INTERESTED PARTIES WHO HAVE BUSINESS BEFORE THIS BOARD
The Oath was administered by Ms. Nathasha Washington, Secretary to the Board of Adjustment, to Benny Beckham, applicants and interested parties with business before this Board.
APPROVAL OF THE MINUTES:
Mr. Pearse Hayes requested a motion for the approval of the minutes for the last Board of Adjustment meeting held on April 2, 2008. Ms. Jennifer Flinn moved to approve the minutes, and Mr. James Andrisin seconded the motion, and it was unanimously approved, 3-0 vote
NEW BUSINESS:
PETITION NO. 1945:
A request by applicant Chancey Padgett for Mason C. & Barbara A Padgett, owner for a hardship variance as provided for in Chapter 407, Article 1, Section 407.01, to allow a manufactured home with an existing manufactured home, and a variance in the (Subdivision Regulation) as provided for in Chapter 407, Article 8 Section 407.73(f)1 of the Alachua County Unified Land Development Regulations, to allow one split of parent parcel 24.75 acres of land to create two lots not fronting a public road in an “Agriculture” Zoning District on property located at 14236 SW 100th Ave, Archer, FL 32618.
DESCRIPION OF PROPERTY:
The Parent Parcel in question begins at the northeast Corner of fractional Section 3, inside Arrendondo Grant, and run South along the section line 4204 feet; thence run West 1026 feet to point of beginning; thence run West 1026 feet more or less to the West Line of Arrendondo Grant; thence run North 1051 feet along the Arrendondo Grant Line; thence run 1026 feet East; thence run 1051 feet South, to point of beginning, lying and being in Township 11 south, Range 18 East. Tax Parcel #04628-003-000. The total Parent Parcel equals apx. 24.75
The Parent Parcel will be dived into two separate North and South Parcels. The first parcel would begin at the Northeast Corner of fractional Section 3, inside Arrendondo Grant, and run South along the section line 4204 feet; thence run West 1026 feet to point of beginning; thence run West 1026 feet more or less to the West Line of Arrendondo Grant; thence run North 467 feet along the Arrendondo Grant Line; thence run 1026 feet East; thence run 467 feet South, to point of beginning, lying and being in Township 11 South, Range 18 East. This parcel will need a new parcel number. This new parcel will equal apx. 11 acres.
The Second parcel created would begin at the Northeast Corner of fractional Section 3, inside Arrendondo Grant, and run South along the section line 3737 feet; thence run West 1026 feet to point of beginning; thence run West 1026 feet more or less to the West Line of Arrendondo Grant; thence run North 584 feet along the Arrendondo Grant Line; thence run 1026 feet East; thence run 584 feet South, to point of beginning, lying and being in Township 11 South, Range 18 East. This parcel should remain with the same existing parcel number of #04628-003-000. This parcel will equal apx 13.75 acres.

p The following comments were submitted by Public Works Department.
This property has access to SR 24 (Archer Road), a State-maintained paved road, via SW 132nd Street and SW 100th Avenue, privately maintained roads that serves more than a dozen other parcels. The Department has determined that the access is suitable for the provision of service; therefore; the Department does not have concerns regarding the creation of an additional family homestead exception lot, particularly since there are already two structures on the property and has no concerns on the hardship variance as these types of requests are generally not significant traffic generators. A driveway permit will not be required for the creation of the additional lot.
p Comments will no longer be provided by the Department of Planning & Development unless they have any concerns and/or questions.
p The Environmental Protection Department has no comments regarding this request:
Mr. Beckham read the petition into the record, and read the Public Works Department comments, adding that the Office of Codes Enforcement would support the request if the board approves the variance. Mr. Beckham distributed picture of the property
Mr. Hayes then requested the petitioner to come forward. Mr. Chancey Padgett approached the podium and commenced his presentation by asking the county to allow him to create two lots from his 24.75 acres of land. Also, to approve him for a hardship variance for Mason C. & Barbara Padgett. So that he can be close to his family to help take care of them.
Mr. Hayes opened up the floor for questioning and/or comments.
After discussion, Mr. James Andrisin made a motion to approve the lot split to create two lot split and hardship variance for Mason C. & Barbara A. Padgett. Ms. Jennifer Flinn seconded the motion and it was approved, 3-0 Vote.
PETITION NO. 1946:
A request by L.A. Davis, owner, for a variance as provided for in Chapter 403, Article 2 – Rural/Agriculture, and Chapter 407, Article 8, Section 407.73(f)1 of the Alachua County Unified Land Development Regulations in the lot width yard setback from 250 feet to 200 feet in an “Agriculture” Zoning District on property located at 1410 NE CR 219A, Hawthorne, FL 32640.
DESCRIPION OF PROPERTY:
The North 200 feet of the North half of the Northeast quarter of the Southeast quarter (N1/2 of NE ¼ of SE ¼) of Section 34, township 9 south, range 22 East or of point of beginning the SE corner of the above,, then running North along right away or County Road 219-A for 200 feet, then running West 664 feet, then running South 200 feet, then running East 664 feet back to point of beginning.

1410 NE CR 219A, Hawthorne, FL 32640
p The following comments were submitted by the Public Works Department.
This property has direct access to NE County Road 219A, a County-maintained paved road, Because of the configuration of the property, the location of the existing drive, along with the total frontage of the entire property; the Department does not oppose the variance in the minimum lot width requirement. The applicant will need to make an application for driveway permit for the newly created lot.

Mr. Beckham read the petition into the record, also read the Public Works comments and stated that the Department of Environmental Protection, Planning & Development have no comments or concerns regarding this petition. The Office of Codes Enforcement would support the request if the board approves the variance. Mr. Beckham distributed pictures of the property.
Mr. Hayes then requested the petitioner to come forward. Mr. L.A. Davis approached the podium and explained to the Board that he would like a variance to change the lot width yard setback from 250 feet to 200 feet in an Agriculture Zoning District on property located at 1410 NE CR 219A, Hawthorne, FL.
Mr. Hayes opened up the floor for questioning and/or comments.
Ms. Jennifer Flinn made a motion to approve the petitioner’s request for a variance to change the lot width yard setback from 250 feet to 200 feet in an Agriculture Zoning District. Mr. James Andrisin seconded the motion and it was unanimously approved, 3-0 Vote
